Welcome to Quinceañeras on a Budget (the "Site"), operated by New Dawn Photo ("we," "us," "our"). By accessing or using the Site — including our vendor directory (the "Directory"), articles, guides, and tools — you agree to these Terms of Use ("Terms"). If you do not agree, please do not use the Site.
1. What the Site Is (and Is Not)
The Site is a free informational resource for families planning quinceañeras and related celebrations. The Directory lists third-party vendors — photographers, venues, caterers, dress shops, DJs, and others — as a convenience. We are not a party to any transaction between you and any vendor. We do not provide, sell, broker, or fulfill any vendor’s services. Any contract you enter is between you and the vendor alone.
2. Vendor Listings Are Not Endorsements
We do not vet, license-check, background-check, insure, or guarantee any vendor listed in the Directory. A listing — including any "verified" badge or similar indicator, which reflects only a limited point-in-time check — is not an endorsement, recommendation, warranty, or guarantee of any vendor’s identity, qualifications, licensure, insurance, pricing, quality, safety, or reliability. Before hiring any vendor, you are responsible for doing your own diligence: check reviews and references, confirm licensing and insurance where applicable, get a written contract, and be careful with deposits. You deal with vendors entirely at your own risk.
3. Informational Content Only
Articles, guides, budgets, checklists, and similar content on the Site are general information, not professional advice. Prices, availability, and vendor details can change without notice, and we do not guarantee the accuracy, completeness, or currency of any content on the Site.
4. Acceptable Use
You agree not to: misuse the Site or interfere with its operation; scrape, harvest, or republish Directory data in bulk; submit false, deceptive, or unlawful content (including fake reviews or inquiries); infringe anyone’s intellectual property; or use the Site for any unlawful purpose. We may restrict or terminate access for violations.
5. Intellectual Property
The Site’s content, design, text, graphics, logos, and compilation of the Directory are owned by us or our licensors and are protected by copyright and other laws. Vendor names, logos, and photos belong to their respective owners. You may view and share links to the Site for personal, non-commercial use; any other use requires our written permission.
6. Third-Party Links
The Site links to third-party websites and services (including vendor websites and social media). We do not control and are not responsible for their content, policies, or practices.
7. Disclaimer of Warranties
The Site and the Directory are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
8. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss, injury, cost, or damage arising out of or relating to (a) your use of the Site, (b) any vendor listed in the Directory, or (c) any transaction, communication, or dispute between you and any vendor — including a vendor’s non-performance, poor performance, cancellation, misconduct, or loss of your deposit. Because the Site is free to use, our total aggregate liability arising out of or relating to the Site shall not exceed one hundred U.S. dollars ($100). Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability arising from our own gross negligence, willful misconduct, or fraud. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
9. Indemnification
You agree to defend, indemnify, and hold us harmless from claims arising out of your misuse of the Site, content you submit, or your violation of these Terms or of any law or third-party right.
10. Dispute Resolution; Arbitration; Class Action Waiver
(a) Informal resolution first. Before filing any claim, you agree to email info@quinceanerasonabudget.com describing the dispute and give us thirty (30) days to try to resolve it informally. (b) Binding arbitration. Except as provided in (d), any dispute arising out of or relating to these Terms or the Site shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall take place in Tarrant County, Texas, or by videoconference, before a single arbitrator. To the extent required by the AAA Consumer Rules, we will bear the arbitration fees that those rules assign to the business. (c) Class action waiver. All disputes shall proceed only on an individual basis; class, collective, consolidated, and representative actions are waived. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall proceed in court. (d) Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court for infringement or misuse of intellectual property. (e) 30-day opt-out. You may opt out of this arbitration agreement by emailing info@quinceanerasonabudget.com within thirty (30) days of first using the Site after this arbitration provision was posted, stating your name and that you opt out of arbitration.
11. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Subject to Section 10, exclusive venue for any court proceeding lies in the state or federal courts located in Tarrant County, Texas.
12. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms with a new "Last updated" date, and for material changes we will provide reasonable notice on the Site. Your continued use of the Site after the effective date constitutes acceptance.
13. Severability; Waiver; Entire Agreement
If any provision of these Terms is held invalid or unenforceable, it shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect. Our failure to enforce a provision is not a waiver. These Terms (together with our Privacy Policy and, for vendors, the Vendor Listing Terms) are the entire agreement between you and us regarding the Site.
